No General Statewide Code

Building codes in Delaware are adopted at county and municipal level. Smaller towns generally defer to their county, but not always — we confirm the adopting authority for your address before design.

New Castle County

Adopted the 2021 IBC, IRC, IEBC and ISPSC effective 1 January 2024, with a residential sprinkler requirement phased in from 1 January 2025.

Sussex County

Adopted the 2021 IBC and IRC effective 1 January 2023, with single-family, duplex and townhouse sprinkler provisions exempted.

Kent County

Has operated on an older IBC edition than its neighbours. Because county positions move independently, we verify Kent’s current adoption directly rather than relying on trackers.

Statewide Energy Code

The Regulations for State Energy Conservation Code were amended to the 2024 IECC for residential and the 2024 IECC or ASHRAE 90.1-2022 for commercial, effective 11 April 2026 and applied uniformly statewide.

State Fire Prevention Regulations

The State Fire Prevention Commission and Office of the State Fire Marshal maintain NFPA-based regulations that apply statewide alongside whatever building code the county has adopted.

Do I need sprinklers in a new home?

It depends on the county. New Castle County phased in a residential sprinkler requirement from 1 January 2025, while Sussex County exempted single-family, duplex and townhouse construction. This is one of the clearest examples of why the county-level question has to be settled first.
