The Codes We Design To in New York

The Codes of New York State set the statewide minimum, but the exceptions are what catch out-of-state firms.

2025 Codes of New York State

The 2025 Building Code and Residential Code of New York State are based on the 2024 I-Codes and took effect on 31 December 2025, alongside the 2025 Energy Conservation Construction Code.

New York City Is Separate

Under Executive Law, cities over one million keep their own codes. New York City runs the 2022 NYC Construction Codes with its own filing and review process through the Department of Buildings.

State Fire Prevention and Building Code Council

The Council adopts the Uniform Code, administered by the Division of Building Standards and Codes. Localities may adopt more restrictive standards only with affirmative Council approval.

Energy Code and NYStretch

The 2025 ECCCNYS applies statewide, and NYSERDA publishes the optional NYStretch code that a number of municipalities have adopted on top of it.

All-Electric Buildings Act

New construction up to seven storeys is subject to the all-electric requirements for permits from 1 January 2026, with statutory exemptions. It changes the MEP design brief materially.

Coastal and Flood Provisions

Long Island, the harbour and the Hudson corridor bring wind-borne debris and FEMA flood construction requirements that inland upstate projects never encounter.
